Welcome to KnowPhone, creators of the Phonout family of applications. These Terms and Conditions ("Terms") govern your access to and use of our mobile applications (Phonout for Android, Phonout for Android TV, and Phonout for iOS), website (www.knowphone.in), and related services. By downloading, installing, or using any Phonout application, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our services.

These Terms apply to all users of Phonout products, including parents, guardians, and children using the apps under parental supervision.

1. Acceptance of Terms

By accessing or using any Phonout application, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

• You must be at least 18 years old or have parental/guardian consent to use these apps
• Parents/guardians are responsible for monitoring their children's use of Phonout applications
• You agree to use the apps lawfully and in accordance with these Terms
• These Terms apply to all Phonout products across all platforms (Android mobile, Android TV, iOS)

2. Description of Services

KnowPhone develops and maintains the Phonout family of screen time management applications designed to help parents reduce their children's device addiction and promote healthy digital habits.

Phonout for Android (Mobile)

• PIN-protected screen locks to control device access
• Customizable time limits for daily screen usage
• Automatic lock overlay when time expires
• Progress tracking and detox journey management
• Offline-first operation with optional cloud sync

Phonout for Android TV

• Instant lock out control for television viewing
• Scheduled TV time limits
• Smart TV compatibility
• Sync with mobile app for unified control

Phonout for iOS (Coming Soon)

• All core features from Android version
• iCloud sync support
• Family Sharing integration
• Screen Time API integration

We reserve the right to modify, suspend, or discontinue any feature of our services at any time without prior notice.

3. User Accounts and Registration

Phonout applications operate primarily on-device without requiring traditional user accounts. However:

• You are responsible for maintaining the confidentiality of your 4-digit PIN
• You must not share your PIN with unauthorized persons
• You are responsible for all activities that occur under your PIN
• If premium features are added, you may need to create an account with accurate information
• For TV sync features, minimal device pairing data may be stored in Firebase

4. Subscription and Billing

Free Service

Phonout applications are currently offered as free services with no subscription fees, advertisements, or data selling.

Future Premium Features

If we introduce premium features in the future:

• Subscriptions will be processed through Google Play Billing (Android) or Apple App Store (iOS)
• All payment information is handled by the respective platform (we never store payment details)
• Subscriptions automatically renew unless cancelled before the renewal date
• Refunds will be subject to Google Play's or Apple's refund policy
• You can cancel subscriptions at any time through your platform account

Note: We will provide clear notice and obtain consent before implementing any paid features.

5. User Conduct and Prohibited Activities

You agree not to:

• Attempt to bypass, disable, or manipulate the apps' lock mechanisms or security features

• Reverse engineer, decompile, or disassemble any Phonout application

• Use the apps for any illegal or unauthorized purpose

• Interfere with or disrupt the apps' servers or networks

• Collect or harvest any information from other users

• Transmit any viruses, malware, or harmful code

• Misrepresent your identity or impersonate others

Violation of these terms may result in immediate termination of your access to Phonout applications.

6. PIN Security and Device Management

The 4-digit PIN is the primary security mechanism for parental control across all Phonout applications:

PIN Responsibilities:

• Keep your PIN confidential and secure
• Choose a PIN that children cannot easily guess
• Do not share your PIN with unauthorized individuals
• Change your PIN regularly for enhanced security
• Use the same PIN across Phonout apps for consistency or different PINs per device

Lost or Forgotten PIN:

Since PINs are stored locally on your device for privacy, we cannot recover lost PINs. In case of a forgotten PIN:

• You may need to uninstall and reinstall the app (losing local data)
• Contact support for assistance: support@knowphone.in
• For Android devices: Factory reset may be required in extreme cases

We are not liable for any loss of data or access resulting from forgotten or compromised PINs.

7. Parental Responsibilities

Phonout applications are tools designed to assist parents in managing screen time, but they do not replace active parenting:

• Parents are solely responsible for monitoring their children's device usage
• The apps are intended for use with parental consent and supervision
• Parents should have open conversations with children about healthy screen time habits
• While our locks are designed to be unbreakable, determined children may find workarounds (factory reset, safe mode, etc.)
• Parents should remain vigilant and use Phonout as part of a comprehensive approach to digital wellness
• For TV controls: Parents should secure physical TV power controls if necessary

Phonout is a parenting aid, not a substitute for parental guidance and supervision.

8. Permissions and Device Access

Phonout applications require certain device permissions to function effectively:

Overlay Permission (Android Mobile): Required to display lock screens over other apps

Exact Alarm Permission: Required for accurate timer functionality

Battery Optimization Exemption: Prevents system from interfering with detox timers

Internet Access: Required for toggle sync (TV app) and analytics

Screen Time API (iOS): Apple's framework for monitoring device usage

By granting these permissions, you authorize the apps to use them solely for their stated purposes as outlined in our Privacy Policy.

9. Intellectual Property Rights

All content, features, and functionality of Phonout applications, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of KnowPhone and are protected by international copyright, trademark, and other intellectual property laws.

You May Not:

• Copy, modify, distribute, or create derivative works of the apps
• Use our trademarks, logos, or branding without written permission
• Remove or alter any copyright, trademark, or proprietary notices
• Sell, license, or commercially exploit the apps or their content
• Redistribute Phonout apps outside official app stores

Limited License: We grant you a personal, non-exclusive, non-transferable, revocable license to use Phonout applications for their intended purpose in accordance with these Terms.

10. Multi-Platform Service

Phonout is available across multiple platforms. Platform-specific terms apply:

Android (Mobile & TV): Subject to Google Play Terms of Service and Google's content policies

iOS: Subject to Apple App Store Terms and Conditions and Apple's Review Guidelines (when available)

Cross-Platform Sync: TV and mobile app sync features use Firebase Realtime Database. Sync is optional and can be disabled

11. Disclaimer of Warranties

PHONOUT APPLICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the apps will be uninterrupted, error-free, or secure
• That the apps will achieve specific results in reducing screen time
• That defects will be corrected
• That the apps or servers are free of viruses or harmful components
• Platform-specific features (Android TV controls, iOS Screen Time integration) work on all devices

Your use of Phonout applications is at your sole risk. We do not guarantee that the apps will prevent all unauthorized device access or solve all screen time issues.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KNOWPHONE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF PHONOUT APPLICATIONS.

This includes but is not limited to:

• Direct, indirect, incidental, consequential, or punitive damages
• Loss of data, profits, or business opportunities
• Device malfunction or data loss
• Unauthorized access resulting from compromised PINs
• Children finding workarounds to bypass locks
• TV controls failing or being circumvented
• Emotional or psychological impacts
• Any third-party actions or services (Google Play, Apple App Store, Firebase)
• Platform-specific issues (Android fragmentation, iOS restrictions)

Our total liability for any claims shall not exceed the amount you paid us in the 12 months preceding the claim (currently $0 for free users).

13. Indemnification

You agree to indemnify, defend, and hold harmless KnowPhone, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your misuse of any Phonout application
• Your violation of any third-party rights
• Any unauthorized access to your device resulting from sharing your PIN
• Any dispute between you and your child regarding app usage
• Use of TV control features that interfere with shared viewing spaces

14. Termination

By You

You may stop using any Phonout application at any time by uninstalling it from your device. Local data will be deleted upon uninstallation.

By Us

We may suspend or terminate your access to Phonout applications immediately, without prior notice, if:

• You violate these Terms
• We suspect fraudulent or illegal activity
• We discontinue a service or platform
• Required by law or regulatory authorities
• Platform policies require removal (Google Play, App Store violations)

Effect of Termination: Upon termination, your right to use the apps ceases immediately. Provisions regarding intellectual property, disclaimers, limitations of liability, and indemnification survive termination.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to www.knowphone.in/terms.

• Material changes will be communicated via in-app notification or email (if provided)
• Your continued use of the apps after changes constitutes acceptance
• If you disagree with changes, you must stop using the apps
• We will update the "Last Updated" date at the top of this page

16. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from these Terms or your use of Phonout applications shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us at support@knowphone.in to resolve disputes informally.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KnowPhone regarding your use of Phonout applications and supersede all prior agreements and understandings.

By using any Phonout application (Android Mobile, Android TV, or iOS), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Thank you for choosing KnowPhone to help your family achieve digital wellness.
